Penal Code Section 242 defines battery as "[A]ny willful and unlawful use of force or violence upon the person of another." A misdemeanor battery is punishable by a maximum fine of $2,000 and/or a maximum of 180 days in the county jail unless it was committed against certain people (peace officers, custodial officers, firefighters, emergency medical technicians, lifeguards, process servers, traffic officers, code enforcement officers, animal control officers, etc. performing their duties), in which case there is an increased fine and/or county jail time.

If the battery is committed against a custodial officer, firefighter, emergency medical technician, lifeguard, process server, traffic officer, or animal control officer engaged in the performance of his or her duties, or others under certain other circumstances, and an injury is inflicted on that victim, the battery may even be elevated to a felony punishable by imprisonment in the state prison for 16 months, or two or three years.

If a battery is committed and causes serious bodily injury, the battery can be elevated to a felony punishable by two, three or four years in the state prison.
