Before people are placed under arrest for driving under the influence (DUI) in California, they will be served with a notice of their driver’s license suspensions by law enforcement.  Once served with this notice, people will have 10 days to schedule their hearings with their local California Department of Motor Vehicles (DMV).  If people do not schedule their DMV hearings within 10 days, their driving privileges will remain suspended for up to 6 months or in some cases, longer. 

California DMV Hearings

After people have scheduled their hearings with the DMV, they will be assigned a time and date for their hearing.  People will then have to appear at the DMV at the specified date and time to contest the suspension of their driver’s licenses. 

The actual hearing is presided over by a DMV administrator who acts as a judge and a prosecutor.  The administrator serves as a prosecutor by arguing why the person’s driving privileges should remain suspended.  This is achieved by presenting officer testimony, breath test results and field sobriety test results.  During this time, the offender or his/her attorney can counter arguments by the administrator and challenge evidence.  Once both sides have presented their cases, the DMV administrator will then act as a judge by issuing a verdict of “guilty” or “not guilty”.  If the person is found “not guilty”, his/her driver’s license will be reinstated.  However, if the person is “guilty”, his/her license will remain suspended as ordered by the DMV.
