What should I do after I have been arrested?

After you have been arrested for a crime, the best thing you can do is to retain the services of a criminal defense lawyer.  During this time, police are going to question you and will demand information.  Instead of answering questions, it is always in your best interest to ask for your lawyer to be present.  This will prevent you from making costly mistakes that could negatively impact the final outcome of your case.

What happens if I am not read my Miranda Rights?

After people are placed under arrest, they must be read their rights by law enforcement.  In cases where people are not read their Miranda Rights, anything they have admitted or said to police may not be admissible in court as Miranda Rights inform people of their right to remain silent. 

The district attorney wants to offer me a deal, should I take it?

If you have been offered a deal by the district attorney, you should review the deal and your options with a knowledgeable criminal defense lawyer before accepting.  You need a lawyer on your side that has your best interests in mind as the deal that is offered may not be to your advantage. 

Will I be ordered to serve time in jail?

If you are found “guilty” or accept a plea bargain from prosecutors, you may have to spend time in jail. However, many people are able to avoid spending time in jail by fighting their criminal charges with help from an aggressive defense lawyer. 

If I get probation, will I have to serve time in jail?

Sometimes, when a person is granted probation, he/she will not have to spend time in jail.  However, if you violate the terms of your probation, you may be ordered to serve your original jail sentence.

Yes, your offense will appear on your criminal record unless you are eligible and successfully file for expungement.
