To put it in simple terms, a criminal threat offense involves putting someone in fear for their or their family’s safety. California Penal Code 422 PC states that a criminal threat occurs when the victim is met with threats of physical harm or death and the following conditions are present:

  1. The victim fears for his/her safety and/or that of his/her family;
  2. The perpetrator’s threats are not vague, but clear and specific; and
  3. The threat has been communicated verbally, in writing, or via an electronically transmitted device.

What Are the Penalties for Criminal Threats in California?

Being a "wobbler", a criminal threats offense may be met with a misdemeanor or felony charge, depending on certain factors.
