Assault

The California Penal Code defines an assault as "[A]n unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another. A misdemeanor assault is punishable by a maximum of 180 days in the county jail and/or a maximum fine of $1,000 unless it was committed against certain people (parking control officers, peace officers, firefighters, emergency medical technicians, animal control officers, doctors, nurses, etc. performing their duties), in which case there is an increased fine and/or county jail time. If an assault is committed against a custodial officer who is on duty, the assault can be elevated to a felony.
